Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Catamend application and related services (the “ Service”) provided by Catamend (“we”, “ us”). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Catamend audits your Shopify catalog against a set of deterministic rules, prioritizes findings by impact, and — where you explicitly authorize it — applies fixes to your catalog and records an audit history. Features and rules may evolve over time.
2. Eligibility & account
- You must have an active Shopify store and the authority to install apps and grant the requested permissions for that store.
- You are responsible for maintaining the security of your Shopify account and for all activity that occurs through your use of the Service.
3. Subscriptions, trials & billing
- The Service is offered on paid monthly plans (Starter, Growth, and Pro) with a 3-day free trial. Prices are shown in-app at the point of purchase.
- Billing is handled by Stripe. By subscribing you authorize recurring monthly charges to your payment method until you cancel.
- Subscriptions renew automatically each billing period. You can cancel at any time; access continues until the end of the current paid period. See our Refund & Cancellation Policy.
- We may change plan pricing with reasonable prior notice; changes take effect on your next billing period.
4. Catalog changes & your responsibility
The Service can write changes to your catalog, but only fixes you explicitly authorize. Fixes are designed to be conservative (for example, writing to a field only when it is still empty) and every change is recorded with a before/after audit trail. You remain responsible for reviewing findings and authorized changes, and for maintaining your own backups. We are not liable for the business impact of changes you choose to apply.
5. Acceptable use
You agree not to:
- Use the Service in violation of any law or Shopify’s terms.
- Attempt to gain unauthorized access to the Service, other tenants’ data, or its underlying systems.
- Reverse engineer, resell, or overload the Service, or interfere with its normal operation.
6. Intellectual property
The Service, including its software, rules, and branding, is owned by Catamend and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service. Your store and catalog data remain yours.
7. Third-party services
The Service relies on third parties including Shopify and Stripe. Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that findings will identify every issue.
9. Limitation of liability
To the maximum extent permitted by law, Catamend will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Catamend from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
11. Termination
You may stop using the Service and uninstall it at any time. We may suspend or terminate access if you breach these Terms or to comply with legal obligations. Upon termination, your right to use the Service ceases; data handling is described in our Privacy Policy.
12. Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. The courts located there will have exclusive jurisdiction over any dispute, except where prohibited by law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by notifying you. Continued use of the Service after changes take effect constitutes acceptance.
